Individual Practitioners

If you are a healthcare practitioner, you are vulnerable to:

  1. Claims against you arising out of allegations of medical malpractice (professional negligence which has resulted in harm to a patient (or their death) and consequent loss);
  2. Claims against you arising out of allegations of professional negligence, for example that you have breached someone’s confidentiality;
  3. Complaints against you made by patients, their families, competitors and other parties to the HPCSA, AHPCSA, SANC, National Consumer Commission or other regulatory body that governs your profession;
  4. Public liability claims, for example a patient visiting your premises sits on a chair in your waiting room which collapses beneath them, or they trip and fall down your stairs or their car is damaged whilst in your parking area;
  5. Products’ liability and defective workmanship type claims if you are involved in the supply, ‘crafting’ or sale of any products to your patients where they allege that they have suffered harm caused by such product or defective workmanship on such product;
  6. Claims or complaints against you arising out of the actions or omissions of your employees and locums (vicarious liability);
  7. Criminal charges against you for fraud or culpable homicide if a patient of yours dies and it is alleged that your criminal negligence caused their death.

We can assist you in obtaining cover for all of these exposures. The insurance provides cover for damages awards that may be made against you as well as any settlement amounts paid to patients and your legal defence costs and expenses.

The insurance we arrange on your behalf will include cover for your vicarious liability for your employees and locums. The MPS advertises on its website that their cover does not include cover for you vicarious liability. In this regard we believe that the cover afforded under an insurance policy we can arrange for you is superior to cover offered by the MPS.

We are also able to arrange ‘corporate’ cover for incorporated practices and partnerships (whether or not the individual practitioner partners/directors in that practice or partnership have and wish to maintain their own individual cover).
